The late rent process in Ontario
A calm, step-by-step view of what happens when rent is late, from the first reminder to the Landlord and Tenant Board.
- Rent is late the day after it's due.
- Ontario landlords can't charge general late fees. A capped administration charge for a returned (NSF) cheque is permitted.
- The formal first step is Form N4. It gives the tenant a chance to pay before any application can be filed.
- If rent stays unpaid after the N4 termination date, the landlord can apply to the LTB using Form L1.
Start with a clear record and a reminder
Most late payments are resolved with a polite reminder. Before anything formal, confirm exactly what's owed: which months, what was received and what's outstanding. Only rent belongs in the arrears on an N4.
The rent arrears calculator gives you a month-by-month balance you can check against your ledger.
Late fees and NSF charges
The Residential Tenancies Act doesn't allow landlords to charge penalty-style late fees. A landlord may charge an administration fee for a cheque returned for non-sufficient funds (NSF), subject to the cap in the regulation, plus the bank's actual charges.
Serving an N4
If rent remains unpaid, the landlord can serve Form N4 (Notice to End a Tenancy Early for Non-payment of Rent). The N4 sets out the amount owed and a termination date. If the tenant pays everything owing before the landlord files an application, the notice becomes void.
Applying to the Board (Form L1)
If the tenant hasn't paid by the termination date, the landlord can file an L1 application to evict and collect the rent owed. The Board may order payment, a repayment plan or termination, depending on the circumstances.
Payment plans
Many landlords agree on a written repayment plan instead of going to the Board. Record every payment against the plan and give receipts. A tenant is entitled to a free receipt on request.
Common questions
Can I change the locks if rent isn't paid?
No. Only a Sheriff can enforce an eviction order from the Landlord and Tenant Board.
Can I use last month's rent to cover arrears?
The rent deposit is meant for the last rental period of the tenancy, not current arrears.
Can I include utilities or damage on the N4?
No. The N4 is for rent only. Other amounts are dealt with separately.
Does a partial payment cancel the N4?
No. Only full payment of the amount owing, before the landlord files, voids the notice. Partial payments reduce the balance.
Do I have to give receipts?
Yes, free of charge if the tenant asks. The rent receipt generator can create one.
